There are many ways to explain attorney-client privilege and confidentiality to your client. I like to have fun with it, so I often use the “What happens in Vegas, stays in Vegas” analogy.
I first ask if they’ve seen one of the “What happens in Vegas, stays in Vegas” commercials or heard the saying. (They almost always have.) I then explain that attorney-client privilege and confidentiality is no different: “What happens between us, stays between us.” I then elaborate on it and give a few examples before asking if they have questions.
It’s unconventional, but it’s fun and better yet almost always puts a much needed smile on my client’s face.
